Can you be evicted if you have Coronavirus? What tenants need to know:


The Federal Fair Housing Act prohibits landlords from discrimination against tenants with disabilities, and that includes infection with COVID-19. As listed below, many states and local ordinances implemented anti-discrimination laws. Covid-19 infections fall under the disability rules, thus, a potential tenant is protected from disability discrimination. The same rules apply to homeowners’ associations. They cannot force an owner to move because they have COVID-19.


States Banning Evictions:

Executive Orders

CARES Act §4024 “Temporary Moratorium on Eviction Filings.” - covers “Covered Property” such as those covered by federal acts such as Violence Against Women Act, with federally backed mortgage loans, etc.  This moratorium is set to life on July 27, 2020.
